Mold Remediation Requirements in NY
Only professional mold remediators and mold contracting companies are allowed to offer mold removal services in New York City and NY state. The contractor and/or firm must hold a valid mold certification and mold license, per Article 32 of NY Labor Law (which also defines safe mold work practices).
You cannot ask a regular contractor to remediate mold for you. If they don’t have the appropriate training and certification, someone cannot offer to remove mold as a service.

Are landlords responsible for removing mold in NY?
Who pays to remove mold in New York? Well, it depends what happened.
Landlords are responsible for addressing mold in a rental dwelling – buildings in NYC have a “warranty of hability” clause, meaning they must be fit to live in. There are various requirements to conduct regular inspections and repairs as well as give disclosure notices.
The exception is unless the mold is due to direct negligence on the part of the tenant, or their failure to report known mold problems or a condition that would be expected to lead to mold growth, such as a water leak. In such a case, the tenant would be at fault and responsible for damages.
Normal homeowners and landlords insurance may cover mold, but you should check for a fungi exclusion clause and coverage limits. Accidents and natural disasters (like mold as a result of a flood) may be covered under special insurance.
Regardless, if the tenant was not directly responsible for the mold or conditions leading to it, and they duly reported such to the property manager or owner, then it is the landlord’s duty to fix the mold.
